Terms of Service

1. About these terms

These Terms of Service ("Terms") govern your use of the PweVibe mobile app and related services (together, "PweVibe" or the "Service"), operated by Bagan IT ("we", "us", "our"). By creating an account or using PweVibe, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Service.

2. Who can use PweVibe

You must be at least 13 years old to use PweVibe. If you are under 18, you may only use PweVibe with the permission of a parent or legal guardian, who agrees to these Terms on your behalf. Some rewards, such as lottery tickets, may have their own age requirements set by law or by the partner providing them.

3. Your account

• You can sign up with an email address, a mobile number or a Google account. You must provide accurate information and keep it up to date.
• You are responsible for everything that happens under your account. Keep your password and one-time verification codes private, and tell us straight away at [email protected] if you think someone else has accessed your account.
• One person, one account. You may not create accounts for others, share, sell or transfer your account, or create multiple accounts to collect extra rewards.

4. Community rules

PweVibe is a place for fans to enjoy music and each other's company. When you use communities, chats, statuses, comments or any other feature, you agree not to:

• harass, bully, threaten or impersonate anyone, including artists and other fans;
• post hate speech, sexual content involving minors, graphic violence or other illegal or harmful content;
• share other people's personal information without their consent;
• spam, advertise without our permission, or run scams or phishing;
• post content you don't have the rights to, such as copyrighted music, videos or images;
• cheat, including using bots, scripts, fake accounts, emulators or exploits to earn VibeCoins, votes, streaks or rewards;
• interfere with, reverse engineer or try to gain unauthorised access to the Service or its systems.

You can report content or users inside the app. We may review, remove or restrict content, and mute, suspend or ban accounts, when we believe these rules have been broken.

5. Your content

You keep ownership of the messages, photos, selfies and other content you post ("Your Content"). By posting it, you give us a non-exclusive, royalty-free, worldwide licence to host, store, display and share Your Content within the Service, only as needed to operate, improve and promote PweVibe. This licence ends when you delete the content or your account, except where it has already been shared with others or we must keep it for legal reasons.

You confirm that you have the right to post Your Content and that it doesn't break these Terms or anyone else's rights.

6. VibeCoins & virtual items

• VibeCoins, Diamonds, STAR tokens, avatar items, streak shields, badges and other in-app items ("Virtual Items") are a limited, personal, non-transferable licence to use them inside PweVibe. They are not money, have no cash value, and cannot be sold, transferred or exchanged for cash, except where we offer a specific reward in the app.
• We may change how Virtual Items are earned, priced or redeemed, set expiry dates, or limit how many can be earned, with reasonable notice where practical.
• If Virtual Items are credited by mistake or obtained by cheating or abuse, we may remove them and reverse any rewards redeemed with them.
• If paid features are offered, the price and any additional terms will be shown before you pay. Except where required by law, purchases are non-refundable.
• Unused Virtual Items are lost if your account is closed.

7. Missions & rewards

• Missions may ask you to answer surveys, watch content, visit a partner location, show your QR code to staff or take a selfie as proof. Each mission shows its own requirements and reward.
• Rewards are subject to availability and to any conditions shown in the app, such as stock limits, validity periods and eligibility.
• Some digital rewards need extra details to be delivered, such as your name, NRC number, mobile number or e-wallet number. You must provide accurate details; we are not responsible for rewards sent to incorrect details you provide.
• Rewards provided by partners (for example vouchers, mobile data or credit, e-wallet cashback, lottery tickets and gaming credits) are fulfilled by those partners and may also be subject to their terms. Lottery results are decided by the lottery operator, not by us.
• We may withhold or cancel a reward if we reasonably believe it was obtained through cheating, abuse or a technical error.

8. Concerts, events & partners

Concerts, fan events, fundraising campaigns and partner offers shown in PweVibe may be organised by third parties. Their own terms, including venue rules and refund policies, apply in addition to these Terms. Tickets and bookings shown in the app are personal and must be presented as instructed. We are not responsible for changes, cancellations or the conduct of events run by third parties, but we'll share information we receive about changes when we can.

9. Our content & trademarks

PweVibe, its logo, design, software and the content we or our partners provide (including artist content, videos and images) are protected by intellectual property laws. We give you a limited, personal, non-transferable licence to use the app for its intended purpose. You may not copy, record, redistribute or commercially use content from PweVibe without permission.

10. Suspension & termination

You can stop using PweVibe at any time and ask us to delete your account (see our Privacy Policy). We may suspend or close your account, or limit features, if you break these Terms, if required by law, or to protect other users or the Service. Where reasonable, we'll tell you why. We may also change or discontinue parts of the Service.

11. Disclaimers

We work hard to keep PweVibe running smoothly, but the Service is provided "as is" and "as available". We don't guarantee that it will always be available, error-free or secure, or that content posted by users is accurate. To the extent permitted by law, we disclaim all implied warranties.

12. Limitation of liability

To the extent permitted by law, we are not liable for indirect, incidental or consequential losses, or for loss of data, Virtual Items, profits or goodwill, arising from your use of the Service. Nothing in these Terms limits liability that cannot be limited by law.

13. Governing law

These Terms are governed by the laws of the Republic of the Union of Myanmar. We'll try to resolve any concern with you informally first, so please contact us before starting any formal proceedings.

14. Changes to these terms

We may update these Terms from time to time. If we make significant changes, we'll let you know in the app or by email before they take effect. Continuing to use PweVibe after changes take effect means you accept the updated Terms.
